These Terms of Service ("Terms") constitute a legally binding agreement between you and Spore Wizard ("we," "us," or "our"). They govern your access to and use of our website at sporewizard.com and any purchases you make through us.

We reserve the right to update these Terms at any time. Material changes will be communicated by updating the date on this page. Continued use of our services after such changes constitutes acceptance of the revised Terms.

2. PRODUCTS — RESEARCH USE ONLY

All products sold by Spore Wizard are strictly intended for microscopy, taxonomy, and scientific research purposes only. They are not intended for germination, cultivation, or human consumption.

By purchasing from Spore Wizard, you explicitly acknowledge and agree that:

You will use all purchased products solely for lawful microscopy and research purposes

You will not attempt to germinate, cultivate, or grow any spore products

You are solely responsible for understanding and complying with all local, state, and federal laws applicable to your purchase and intended use

Spore Wizard makes no claims about the legality of any product in your specific jurisdiction — that determination is entirely your responsibility

You are 18 years of age or older

3. PLACING AN ORDER

When you place an order on Spore Wizard, you represent that:

You are at least 18 years of age

You are legally permitted to purchase the products in your jurisdiction

All information you provide (name, shipping address) is accurate and complete

You are not purchasing for resale without prior written authorization

We reserve the right to refuse or cancel any order at our sole discretion, including orders that appear to be placed for commercial resale, orders to restricted jurisdictions, or orders where fraud is suspected.

4. PAYMENT

All payments are made via CashApp. By submitting an order, you agree to send the exact amount listed using the provided order reference code as the memo. Orders are fulfilled only after payment is manually verified.

We do not store, collect, or have access to any payment credentials — all transactions occur directly through CashApp

Payments sent without the correct memo may not be matched to your order; we are not liable for unmatched transactions

5. SHIPPING & DELIVERY

We currently ship to the United States, Canada, United Kingdom, and Australia

Orders are typically processed within 1–2 business days and shipped within 3–5 business days

Shipping timelines are estimates only — we are not responsible for carrier delays, customs holds, or events beyond our control

Risk of loss and title for products pass to you upon delivery to the carrier

We do not ship to California, Georgia, or Idaho due to state-specific restrictions on psilocybin mushroom spore possession

International customers are responsible for any customs duties, import fees, or taxes applicable in their country

6. RETURNS & REFUNDS

Due to the nature of our biological research products, all sales are generally final. However, we will work with you in the following circumstances:

Damaged in transit: If your order arrives visibly damaged, contact us within 7 days of delivery with photos and we will send a replacement.

Wrong item shipped: If you receive the wrong product, contact us within 7 days and we will arrange an exchange at no cost to you.

Missing items: If your order is incomplete, notify us within 7 days of the expected delivery date.

We do not accept returns or exchanges based on change of mind, regulatory changes in your jurisdiction after purchase, or user error.

7. PROHIBITED ACTIVITIES

You agree not to use Spore Wizard for any of the following:

Any unlawful purpose or in violation of any local, state, national, or international law or regulation

Purchasing with the intent to cultivate psilocybin-containing mushrooms

Reselling our products without written authorization

Attempting to access our systems without authorization, or disrupting the website's operation

Submitting false information, fraudulent payment, or impersonating another person

Using our content, images, or product descriptions without explicit written permission

8. INTELLECTUAL PROPERTY

All content on Spore Wizard — including but not limited to text, images, product names, logos, graphics, and website code — is the property of Spore Wizard and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from our site without our prior written consent.

9. DISCLAIMER OF WARRANTIES

Products are sold "as is" for research and microscopy use only. Spore Wizard makes no warranties, express or implied, regarding the fitness of any product for any particular purpose beyond lawful microscopy research.

We do not warrant that the website will be uninterrupted, error-free, or free from viruses. We do not warrant product availability and reserve the right to discontinue any product at any time.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Spore Wizard shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

Your use or misuse of our products for any purpose

Any legal consequences arising from your purchase or possession of our products

Shipping delays, losses, or damage by third-party carriers

Unauthorized access to your data

Any errors or omissions in our website content

In no event shall our total liability exceed the amount you paid for the specific order giving rise to the claim.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of Spore Wizard shall be subject to binding arbitration, except where prohibited by law. You waive the right to participate in a class action lawsuit or class-wide arbitration.
